2. DEFINITIONS

For the purposes of these Terms:

– “gyfros” indicates the physical product gyfros Tag and, where applicable, the associated digital service;
– “Tag” refers to the physical product that is attached to the dog collar and is equipped with a unique QR code;
– “Service” refers to the digital features associated with the Tag and the dog’s profile;
– “Public profile” refers to the page accessible by scanning the QR code;
– “Owner Area” indicates the area reserved through which the owner can manage the information associated with their dog;
– “Customer” or “User” refers to the person who purchases or uses gyfros;
– “Consumer” means a natural person acting for purposes unrelated to their trade, business, craft or professional activity.

3. DESCRIPTION OF GYFROS

gyfros is a system composed of:

a) a physical tag that can be attached to the dog’s collar;
b) a unique QR code engraved on the Tag;
c) an associated digital service that allows the owner to create and manage a dog profile;
d) a public page accessible by scanning the QR code, in which the information the owner has decided to make available can be displayed.

The person who scans the QR code does not have to install an application or create an account to view the Public Profile.

4. PURPOSE OF THE SERVICE

gyfros is designed to make selected information about the dog, provided by the owner, more easily accessible, including:

– identification data of the dog;
– contact details of the owner;
– emergency contacts;
– any veterinary references;
– health or management information deemed useful by the owner.

gyfros is an informational and support tool.

It does not constitute and does not replace:

– the microchip or other mandatory identification systems of the animal;
– registration in the animal registers provided for by law;
– an official veterinary medical record;
– a veterinary visit or assessment;
– an emergency veterinary service;
– a medical device;
– a GPS location system;
– a tool that guarantees the recovery of the animal.

5. CHARACTERISTICS OF THE PHYSICAL PRODUCT

In its current configuration, the gyfros Tag features:

– central plate in stainless steel;
– elastic side supports made of food-grade silicone;
– QR codes and logos created using laser engraving;
– slide-on design, intended to be applied directly to the collar without a pendant element;
– availability in sizes S, M and L.

The photographs, images and representations present on the website are for illustrative purposes only.

Small, non-substantial differences in color, finish, or appearance may depend on the production processes and the devices used to display the images.

6. MATERIALS AND TECHNICAL DOCUMENTATION

The materials used are accompanied by technical documentation and test reports provided by the physical manufacturer and the suppliers of the raw materials.

The available documentation includes, as applicable to samples and materials submitted for testing, references to:

– REACH / SVHC;
– RoHS;
– FDA 21 CFR 177.2600;
– LFGB / BfR;
– technical documentation relating to stainless steel.

These documents relate to the materials or samples subjected to the specified tests and do not constitute, unless expressly indicated in the documentation, a comprehensive certification of the finished product.

Therefore, gyfros does not describe the finished product as “FDA certified”, “SGS certified”, “REACH certified”, “FDA approved” or use equivalent wording unless it holds a specific certification directly covering the finished product.

7. MANUFACTURER AND PHYSICAL PRODUCER

For the purposes of European Union regulations applicable to the general safety of products, the product is marketed under the name and brand of gyfros.

Manufacturer under applicable EU regulations:

gyfros di Giampaolo Carucci
Via di Vagno 13
74018 Palagianello (TA)
Italy

VAT number: 02938160542
Email: info@gyfros.com

Physical producer/supplier:

Shenzhen Xinxiangtai Technology Co., Ltd.
B2-306, East District, Jiahua Garden
Xixiang Street, Bao'an District
Shenzhen, China

The physical producer manufactures the product according to the agreed specifications, while gyfros markets the product under its own name and brand and assumes, within the limits provided by applicable regulations, the obligations associated with its role as a manufacturer in the European Union.

8. IDENTIFICATION AND TRACING

The product is marketed as “gyfros Tag” in sizes S, M and L.

The following internal traceability code was attributed by gyfros to the first production:

GYF-2026-01

This code constitutes an internal traceability reference.

Separate SKU codes can also be used for sizes.

Each Tag has a unique QR code that also serves as a functional element for identifying the individual Tag.

9. SIZE AND ASSEMBLY CHOICE

gyfros is available in three sizes, with elastic silicone side supports:

S – for narrow collars, generally used for small dogs.

M – for medium-width collars, generally used for medium-sized dogs.

L – for wide collars, generally used for large-sized dogs.

As a guide, the openings of the supports measure at rest approximately:

S – 1.5 cm

M – 2 cm

L – 3 cm

The elasticity of the silicone allows the supports to adapt to slightly wider collars.

The measurements above refer to the opening of the supports when not stretched and do not indicate the maximum width of a compatible collar.

The main criterion for choosing the size is the width of the collar.

The size of the dog should be considered only as a general guide.

Before purchasing, the customer is invited to check the width of the collar and to choose the most suitable size.

The Tag must be installed correctly, without any tampering, and in accordance with its slide-on function.

The customer is responsible for:

– choosing the appropriate size;
– correctly installing the Tag on the collar;
– checking its compatibility with the collar being used;
– periodically checking the condition of the Tag and its supports.

The product must not be forced onto harnesses with incompatible dimensions or characteristics.

10. SAFETY AND CORRECT USE

The Tag is intended exclusively for application to the dog’s collar according to the intended use.

It is not a toy.

The owner must periodically check:

– integrity of the plate;
– integrity of the side supports;
– correct attachment to the collar;
– readability and scanability of the QR code.

In the presence of cracks, deformations, loose parts, cuts or other signs of deterioration, the product must be immediately removed from the collar and not used until it is replaced or its safety has been verified.

11. RISK OF CHEWING, INGESTION AND USE BY CHILDREN

The product and its parts must not be chewed or ingested.

The Tag must be used exclusively as an accessory attached to the dog’s collar and must not be left with the animal as a toy.

When not properly applied to the collar, the product must be kept out of the reach of children and animals.

If, as a result of damage or improper use, components of the product become detached, they may constitute a risk of ingestion or suffocation.

To the extent permitted by applicable law, gyfros shall not be liable for damage resulting from:

– chewing;
– ingestion;
– use as a toy;
– intentional disassembly;
– lack of supervision;
– use by children;
– use other than the intended use.

This limitation does not apply where liability cannot be excluded or limited under applicable law.

12. CLEANING AND MAINTENANCE

For normal cleaning of the Tag, it is recommended to use:

– water;
– a soft cloth;
– thorough drying before reuse.

The following must be avoided:

– aggressive detergents;
– bleach;
– solvents;
– abrasive products;
– treatments that could damage the silicone, the metallic surface or the readability of the QR code;
– prolonged immersion in alkaline liquids.

The customer must periodically check the condition of the product.

13. PACKAGING AND LABELING

The product is supplied in a dedicated packaging comprising paper/cardboard materials, magnetic elements integrated into the packaging structure and a soft inner insert designed to accommodate and protect the Tag.

The packaging is intended for the containment, protection and presentation of the product.

Packaging is not a toy.

It should not be:

– chewed;
– ingested;
– disassembled;
– left within reach of children or animals as a toy.

The magnetic closures integrated into the package must not be removed or manipulated.

If the packaging is damaged to the point that magnets, small parts or other internal elements become accessible, it must be kept out of the reach of children and animals and properly disposed of.

14. ACCOUNT CREATION, ACCESS AND EMAIL COMMUNICATIONS

Following the purchase, the customer receives the necessary communications for the creation and management of the account at the e-mail address provided during the order.

The normal flow includes:

– creation of the account associated with the email address used during the purchase;
– sending a communication to set the password;
– access to the Owner Area;
– the possibility to start filling out the dog’s profile even before the physical receipt of the Tag;
– subsequent management and updating of the profile through the Owner Area.

The customer can use the “Forgot password?” function on the login page to reset their password.

The customer is responsible for:

– providing a correct email address;
– keeping their login credentials secure;
– any use made of their account;
– the information entered in the associated dog profiles.

The customer must inform gyfros if they suspect unauthorized use of their account.

gyfros may send transactional and service communications necessary for the management of the purchase, account and service, including:

– communications related to the creation of the account;
– instructions or links to set or reset the password;
– confirmations and updates regarding orders;
– communications related to the management of the profile;
– functional notifications provided by the service;
– support or security communications.

Such communications are transactional or functional in nature and do not constitute newsletters or periodic promotional communications.

15. ASSOCIATION OF THE TAG WITH THE DOG AND SIZE ASSIGNMENT

Each Tag is normally intended to be permanently associated with a single dog.

When the customer purchases a specific size S, M or L, the system assigns or makes available a Tag belonging to the corresponding size category.

The technical association between the order, Tag, account and dog profile may be carried out automatically or through internal management procedures.

The customer can start filling out the dog profile immediately after purchase, even before the physical receipt of the Tag.

Once associated with the relevant account and profile, the Tag is intended for use with the indicated dog.

In the standard configuration of the service, there is no autonomous function that allows the customer to freely change the dog associated with the Tag or transfer the Tag to another account.

In special circumstances, the customer may contact:

info@gyfros.com

gyfros will assess whether the Tag can be manually reset, unlinked or reassigned.

Such operations are not an automatic right of the user and may require identity, security and ownership checks.

16. USER RESPONSIBILITY FOR THE INFORMATION ENTERED

The owner is responsible for the accuracy, timeliness and legality of the information entered in the profile.

gyfros does not systematically verify the clinical or factual accuracy of the information entered by the user.

It is the owner's responsibility to update the information when it changes.

When personal data relating to third parties, such as an emergency contact or veterinarian, is entered, the user must be authorized to provide that data and must do so in accordance with the Privacy Policy.

17. PUBLIC PROFILE

Scanning the QR code provides access to the information that the owner has chosen to make available in the Public Profile.

Information that has not been entered or made public by the user will not be displayed in the Public Profile.

The owner must carefully consider which information to make available, as anyone able to scan the QR code may access the Public Profile.

18. NATURE AND MINIMUM TERM OF THE DIGITAL SERVICE

The basic digital service associated with the gyfros Tag is included in the purchase price and, in the current commercial configuration, does not require a separate mandatory subscription.

gyfros makes the basic digital service available for a minimum period of 12 months from the date of purchase.

The 12-month period constitutes the minimum contractual duration of the basic digital service included in the purchase and does not constitute a promise of perpetual or “lifetime” availability.

After the minimum 12-month period has elapsed, gyfros may continue to provide the basic service under the technical and commercial conditions then in force.

Any continuation of the service beyond that period does not automatically create an obligation of perpetual availability.

During the period in which the service is provided, temporary interruptions may occur due to maintenance, updates, security requirements, technical failures, the unavailability of third-party providers, force majeure events or other circumstances beyond the reasonable control of gyfros.

gyfros will take reasonable measures to prevent or limit such interruptions and, where possible, restore the service within a reasonable time.

If the service cannot be provided or restored and this constitutes a lack of conformity or another infringement of the consumer’s rights, the remedies provided by applicable law remain available.

The minimum 12-month period does not limit or replace any mandatory rights granted to consumers under applicable law in relation to legal guarantees, goods with digital elements, digital content or digital services.

19. UPDATES TO THE SERVICE

gyfros may carry out updates necessary to:

– maintain security;
– correct errors;
– improve stability;
– ensure technical compatibility;
– comply with applicable law;
– maintain the service in conformity with its required characteristics.

The ancillary features of the service may evolve over time, provided that any changes comply with the consumer’s mandatory rights.

The updates necessary to maintain compliance and safety are managed in compliance with applicable regulations.

20. AVAILABILITY OF THE SERVICE

gyfros adopts reasonable measures to ensure the availability of the service during the period when it must be provided.

However, continuous and uninterrupted availability 24 hours a day, 7 days a week cannot be guaranteed.

Temporary interruptions may occur, for example due to:

– scheduled or extraordinary maintenance;
– updates;
– hardware or software failures;
– network or connectivity problems;
– unavailability of third-party suppliers;
– problems with the hosting service;
– computer attacks;
– unauthorized access attempts;
– security incidents;
– events of force majeure;
– circumstances beyond the reasonable control of gyfros.

gyfros undertakes to take reasonable measures to restore the service and mitigate the effects of the interruption.

These limitations do not exclude liability or remedies that cannot be excluded or limited under applicable law.

21. INFORMATION SECURITY

gyfros implements reasonable technical and organizational measures to protect the service and the data processed through it.

However, no computer system can guarantee absolute security or total immunity from:

– computer attacks;
– vulnerabilities not yet known;
– unlawful access;
– failures affecting third-party services;
– unavailability of external infrastructures.

In the event of significant incidents, gyfros will take the measures required by applicable regulations.

22. ORDERS

Orders are placed through the website https://gyfros.com.

Before the order is finalized, the customer can check:

– selected product;
– selected size;
– quantity;
– price;
– billing data;
– shipping data;
– method of payment;
– any additional costs indicated in the checkout.

The order is considered received when the customer receives the order confirmation generated through the website.

gyfros may refuse or cancel an order in cases permitted by law, for example in the event of:

– unavailability of the product;
– unavailability of the selected size;
– manifest error in the price;
– suspected fraud;
– impossibility of processing the payment;
– information that is clearly incorrect or insufficient to complete delivery.

Any amounts already collected will be refunded where required.

23. PRICES

The applicable price is that displayed on the product page and in the checkout at the time of ordering.

Prices are displayed in accordance with the applicable tax regime.

Any shipping costs or other costs are indicated to the customer before the order is finalized.

Subsequent price changes do not affect orders that have already been validly concluded.

24. PAYMENTS

The available payment methods are displayed to the customer in the checkout.

In the current configuration, the following are available:

– PayPal;
– Google Pay;
– payment cards;
– any other methods made available through the payment system integrated into the website.

Cash payment is not accepted, unless otherwise expressly stated at checkout.

Some payments may be technically processed through WooPayments and/or Stripe infrastructure, depending on the payment configuration active at the time of purchase.

Payment services are also subject to the terms, conditions and privacy notices of the respective providers.

gyfros does not store the customer’s complete payment card details.

25. GEOGRAPHIC AREA OF SALE

During the initial phase, gyfros sells and delivers products within Italy.

If sales are extended to other countries in the future, different shipping conditions, prices, delivery times and specific arrangements may apply.

26. SHIPPING

Shipments are handled through Packlink and the carriers available through that service.

The estimated delivery time within Italy is:

3–5 working days

Delivery may take longer in the event of:

– remote locations;
– holidays;
– causes attributable to the carrier;
– adverse weather conditions;
– peaks of demand;
– force majeure;
– other circumstances beyond the reasonable control of gyfros.

The delivery time indicated is an estimate and does not guarantee delivery on a specific date unless expressly agreed otherwise.

The maximum delivery periods and consumer rights provided by applicable law remain unaffected.

27. TRANSFER OF RISK

For sales to consumers, the risk of loss of or damage to the goods passes to the customer when the customer, or a third party designated by them other than the carrier, physically takes possession of the product, unless otherwise provided by law.

28. RIGHT OF WITHDRAWAL

Subject to the exceptions provided by law, a consumer who makes a distance purchase has the right to withdraw from the contract within 14 days from the date on which they acquire physical possession of the product, without having to provide any reason.

To exercise the right of withdrawal, the consumer must clearly notify gyfros of their decision by contacting:

info@gyfros.com

or by written communication addressed to:

gyfros di Giampaolo Carucci
Via di Vagno 13
74018 Palagianello (TA)
Italy

29. RETURN OF THE PRODUCT FOLLOWING WITHDRAWAL

Following withdrawal, the consumer must return the product within the period and in accordance with the conditions provided by law.

The product must be returned to:

gyfros di Giampaolo Carucci
Via di Vagno 13
74018 Palagianello (TA)
Italy

The direct cost of returning the product following the exercise of the right of withdrawal is borne by the consumer.

Where possible, the consumer is requested to return:

– Tag;
– any accessories;
– original packaging;
– documentation received.

The lack of the original packaging does not automatically entail the loss of the right of withdrawal.

The consumer is responsible for any reduction in the value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

30. REFUND FOLLOWING WITHDRAWAL

The refund will be made within the time limits and under the conditions provided by applicable law.

Where permitted by law, gyfros may withhold the refund until the product has been received or until the consumer provides evidence that it has been returned, whichever occurs first.

The refund will normally be made using the same payment method used for the original purchase, unless the consumer expressly agrees otherwise.

31. WITHDRAWAL AFTER ACCOUNT CREATION OR TAG ASSOCIATION

Creating an account, setting a password, completing the dog profile or associating the Tag with the corresponding profile does not automatically result in the loss of the right of withdrawal for the physical product where that right is provided by law.

In the event of a valid withdrawal, gyfros may, where technically applicable:

– unlink the Tag;
– delete or disable the relevant profile;
– reset the QR code;
– make the Tag technically available again.

The processing of personal data following termination of the contractual relationship is governed by the Privacy Policy and by any retention obligations provided by law.

32. PRODUCT DAMAGED UPON DELIVERY

The customer is invited to check the product upon receipt.

Any of the following:

– breakages;
– deformations;
– obvious abnormalities;
– missing parts;
– immediately visible defects;

should preferably be reported within 7 days of delivery by writing to:

info@gyfros.com

and, where possible, including:

– photographs;
– description of the problem;
– order number.

The 7-day period is indicated for organizational purposes and to facilitate the prompt handling of the report; it does not limit any mandatory rights arising from the legal guarantee.

33. LEGAL WARRANTY OF CONFORMITY

New products sold to consumers are covered by the legal guarantee of conformity provided by applicable law.

The seller's liability covers defects of conformity for which the seller is liable in accordance with applicable law.

For new goods, the legal guarantee lasts for the period provided by law, currently two years from delivery.

The specific provisions of applicable law remain in force for goods with digital elements and associated digital services.

The legal guarantee applies independently of any additional commercial guarantee.

The minimum 12-month period provided for the basic digital service does not limit or replace the legal guarantee or any other mandatory consumer rights.

34. EXCLUSIONS FROM THE LEGAL GUARANTEE FOR DAMAGE CAUSED AFTER DELIVERY

The legal guarantee does not cover damage that is not attributable to a lack of conformity and that results, for example, from:

– normal wear and tear;
– bites from the animal;
– scratches;
– excessive pulling;
– impacts;
– crushing;
– abrasions;
– cuts;
– damage caused by the animal;
– incorrect installation;
– incompatible collar;
– improper use;
– lack of or poor maintenance;
– use of unsuitable chemicals or cleaning products;
– alterations or tampering;
– disassembly;
– external causes after delivery.

The fact that a problem arises during the legal guarantee period does not automatically mean that damage resulting from use is attributable to an original lack of conformity.

35. MANAGEMENT OF DEFECTS

To report a possible defect, the customer may write to:

info@gyfros.com

indicating:

– order number;
– description of the problem;
– photographs, if useful;
– additional information necessary to assess the case.

gyfros may request the return of the product in order to assess its condition.

Where a lack of conformity covered by the legal guarantee exists, the consumer is entitled to the remedies provided by applicable law.

Where appropriate, gyfros may replace the Tag with a new one at no cost to the consumer.

36. LIMITATIONS OF LIABILITY REGARDING HEALTH INFORMATION

The information contained in the profile is entered by the user and is provided for informational purposes.

gyfros does not:

– make diagnoses;
– automatically validate clinical information;
– prescribe treatments;
– replace the attending veterinarian;
– guarantee that the information entered is complete or up to date.

In a health emergency, clinical decisions must be made by a veterinarian on the basis of an assessment of the animal and any information considered reliable.

37. NO GUARANTEE OF RECOVERY OR INTERVENTION

The presence of the Tag does not guarantee:

– that the dog is found;
– that a person scans the QR code;
– that the person performing the scan contacts the owner;
– that the information is used by a veterinarian;
– that the owner is reachable;
– that any particular outcome can be prevented.

gyfros is an informational tool and does not provide a location-tracking or emergency service.

38. ILLEGAL OR ABUSIVE USE OF THE SERVICE

It is forbidden to use gyfros for:

– illegal activities;
– fraud;
– impersonation of third parties;
– publication of abusive or harmful content;
– compromising the security of the website;
– unauthorized access;
– unauthorized or abusive automated scanning;
– attempts to alter or manipulate the functioning of the service.

Where reasonable grounds relating to security or unlawful use exist, gyfros may take proportionate measures, including temporarily suspending the account or service, in accordance with applicable law.

39. INTELLECTUAL PROPERTY

The gyfros trademark, logo, graphic elements, original website content and other protected materials are owned by gyfros or by their respective rights holders.

The purchase of the Tag does not transfer to the customer any intellectual property rights over the brand, software, graphics or digital infrastructure.

Such elements may not be reproduced, modified or used for commercial purposes without prior authorization.

40. PRIVACY, COOKIES AND MEASUREMENT TECHNOLOGIES

The processing of personal data is governed by the Privacy Policy published on the website.

The use of cookies and similar technologies is governed by the Cookie Policy and the consent management system available on the website.

Consent to the use of cookies and statistical or marketing technologies may be granted, refused or modified through the consent management tools available on the website.

Refusing non-essential cookies or technologies does not prevent the use of the essential features of the website and service.

The Privacy Policy and Cookie Policy are separate notices from these Terms and Conditions.

41. MODIFICATIONS TO THE TERMS AND THE SERVICE

gyfros may update these Terms in response to:

– changes in applicable law;
– evolution of services;
– introduction of new features;
– technical or safety requirements;
– commercial changes.

For purchases already concluded, the conditions in force at the time the contract was entered into remain applicable, unless changes are required by law or validly accepted by the customer.

Any changes to the terms, functionality or availability of the digital service will be made in accordance with applicable law and without prejudice to the consumer’s existing rights.

After the minimum contractual period of 12 months has expired, any continuation, modification, replacement or termination of the service will remain subject to the mandatory requirements of applicable law.

42. FORCE MAJEURE AND EVENTS BEYOND REASONABLE CONTROL

To the extent permitted by law, gyfros shall not be liable for delays or temporary inability to perform its obligations due to events beyond its reasonable control, including, by way of example:

– natural disasters;
– fires;
– wars;
– widespread strikes;
– power outages;
– telecommunications outages;
– extraordinary infrastructure failures;
– particularly serious cyberattacks;
– actions or orders issued by public authorities;
– similar unforeseeable or unavoidable events.

Should such events temporarily prevent the provision of the service, gyfros will take reasonable measures to limit their effects and restore the service wherever possible.

If performance becomes permanently impossible or the circumstances give rise to specific consumer remedies under applicable law, those remedies remain available.

This provision does not limit any mandatory rights granted to consumers.

43. APPLICABLE LAW

These Terms and Conditions are governed by Italian law.

Consumers residing in another country retain the benefit of any mandatory protections granted by the law applicable to them.

44. DISPUTES AND JURISDICTION

For any complaints, the customer is invited to contact:

info@gyfros.com

in order to seek a possible amicable resolution.

Disputes involving consumers shall be subject to the jurisdiction determined by the applicable mandatory rules, including, where provided by law, the court of the consumer’s place of residence or domicile.

For transactions that do not involve a consumer, jurisdiction shall be determined in accordance with applicable law, unless otherwise validly agreed.

45. SEVERABILITY

If any provision of these Terms is found to be invalid, ineffective or unenforceable, the remaining provisions shall remain effective to the extent permitted by law.

46. PREVALENCE OF MANDATORY CONSUMER RIGHTS

No provision of these Terms is intended to exclude or limit any rights or liabilities that cannot be excluded or limited under applicable law.

In the event of a conflict between a provision of these Terms and a mandatory consumer protection rule, the latter shall prevail.
